卖家资格与合规义务
Seller Eligibility & Compliance
申请入驻"厂家直销"板块的卖家须为合法注册的企业或个体经营者,拥有出售所列商品的合法权利。卖家保证:(1)所有商品信息真实、准确、不具误导性;(2)商品不侵犯任何第三方知识产权(商标、专利、版权);(3)商品符合出口国及进口国适用的安全与质量标准;(4)不销售任何违禁、限制或仿冒商品。
Sellers must be legally registered businesses or sole proprietors with the lawful right to sell listed products. Sellers warrant that: (1) all product information is truthful, accurate, and non-misleading; (2) products do not infringe any third-party intellectual property; (3) products comply with applicable safety and quality standards in the country of export and import; (4) no prohibited, restricted, or counterfeit goods are listed.

Prohibited Listings
以下商品或信息严禁在本平台发布:仿冒品及"山寨"品牌商品;违反美国出口管制法(EAR)或OFAC制裁的商品;未获FDA批准的食品、药品或医疗器械;枪支、弹药及管控物品;任何违反美国联邦或纽约州法律的产品或服务。平台有权随时删除违规内容并注销账号,情节严重者将向执法机构举报。
The following are strictly prohibited: counterfeit or knockoff brand goods; items violating U.S. Export Administration Regulations (EAR) or OFAC sanctions; unapproved food, drugs, or medical devices; firearms and controlled items; any product or service violating U.S. federal or New York State law. Link NY News may remove content and suspend accounts at any time; serious violations may be reported to law enforcement.

账号安全与信息维护责任
Account Security & Content Responsibility
卖家须妥善保管账号密码,对通过账号发布的全部内容承担法律责任。如发现账号被盗用,应立即通知平台。卖家有义务保持商品信息的及时更新(如缺货、停产、价格变动),过期或错误信息造成的买家损失由卖家自行负责。
Sellers are responsible for keeping account credentials secure and bear legal responsibility for all content posted through their account. Any unauthorized access must be reported immediately. Sellers are obligated to keep product listings current; sellers bear responsibility for buyer losses caused by outdated or incorrect information.

退货、退款与售后政策
Returns, Refunds & After-Sales Policy
厂家直销卖家须在商品详情页清晰公示退货与退款政策,并满足以下最低标准:
- 商品质量问题:买家收货后 30 天内,如商品存在制造缺陷、与描述严重不符或运输损坏,卖家须提供全额退款或免费换货,退货运费由卖家承担。
- 非质量原因退货:卖家可自行设定接受无理由退货的期限(建议不少于 7 天),但须在商品页面明确标注;若卖家不接受非质量原因退货,亦须在商品页面显著注明。
- 退款时限:平台确认退货或卖家同意退款后,卖家须在 7 个工作日内完成退款,逾期未退视为违约。
- 争议处理:买卖双方发生退货争议时,平台客服可介入调解;若卖家无正当理由拒绝退款,平台有权代为处理并从卖家账号扣除相应金额或暂停店铺。
- 不可退货情形:定制产品、生鲜食品、已拆封的个人护理品等特殊商品可标注"不支持退货",但须在购买前向买家明确提示。
Factory Direct sellers must clearly disclose their return and refund policy on each product listing and comply with the following minimum standards:
- Quality issues: Within 30 days of receipt, if a product has manufacturing defects, materially differs from its description, or was damaged in transit, the seller must offer a full refund or free replacement; return shipping costs are the seller's responsibility.
- Non-quality returns: Sellers may set their own no-questions-asked return window (minimum 7 days recommended) but must state it clearly on the listing; if no-questions-asked returns are not accepted, this must be prominently disclosed.
- Refund timeline: Once a return is confirmed or a refund agreed upon, sellers must complete the refund within 7 business days; overdue refunds constitute a breach of these terms.
- Dispute resolution: When a return dispute arises, Link NY News customer support may mediate; if a seller refuses a refund without valid reason, Link NY News may process the refund on the seller's behalf and deduct the amount from the seller's account or suspend the store.
- Non-returnable items: Custom-made products, perishable food items, opened personal care products, and similar goods may be listed as non-returnable, but buyers must be clearly informed before purchase.

合法经营与执照要求
Lawful Operation & Licensing
入驻商家须拥有在纽约市(或实际经营地)合法开展相关业务的全部执照与许可证,并保证在整个入驻期间持续有效。商家须在经营期间遵守纽约市、纽约州及美国联邦的相关法律法规,包括但不限于:《纽约市行政法》、《纽约卫生法》、《联邦食品药品化妆品法》(食品商家)及相关专业执照法规(美发、美容、医疗等)。
Merchants must hold all licenses and permits required to legally operate in New York City (or their actual location) and must maintain their validity throughout the listing period. Merchants must comply with all applicable NYC, New York State, and U.S. federal regulations, including the NYC Administrative Code, New York Sanitary Code, federal Food Drug and Cosmetic Act (for food businesses), and professional licensing laws (beauty, cosmetology, healthcare, etc.).

信息真实性与广告规范
Truthfulness & Advertising Standards
商家发布的所有信息(包括名称、地址、营业时间、价格、服务内容、优惠活动及资质证书)须真实、准确,不得有任何欺骗性、虚假或误导性内容。商家的广告与促销活动须符合《纽约州一般商业法》第349条(禁止欺骗性行为),以及联邦贸易委员会(FTC)广告指南。商家须对信息变更(如涨价、停业、更换地址)及时更新,否则因延误更新造成消费者损失,商家自行承担责任。
All merchant information (name, address, hours, prices, services, promotions, certifications) must be truthful, accurate, and free from deception, misrepresentation, or misleading content. Advertising must comply with New York General Business Law §349 (prohibition of deceptive acts) and FTC advertising guidelines. Merchants must promptly update any changes; merchants bear responsibility for consumer losses caused by delayed updates.

订单履约与消费者保护
Order Fulfillment & Consumer Protection
商家通过平台接收的订单或预约,须按照所展示的服务承诺履约。商家须建立明确的退款政策并在店铺页面公示;拒绝无理由退款或故意拖延退款视为违反本条款。消费者在付款后有权就商家未履约或服务质量问题提出正式投诉,平台保留依据投诉情况对商家进行警告、下架或永久注销的权利。
Merchants must fulfill orders and reservations received through the platform in accordance with their advertised service commitments. Merchants must establish and publicly display a clear refund policy; unreasonable refusal or deliberate delay of refunds constitutes a breach of these terms. Consumers who have paid are entitled to file formal complaints regarding non-fulfillment or service quality issues; Link NY News reserves the right to issue warnings, suspend listings, or permanently revoke merchant accounts based on complaints.

平台处罚权与独立运营声明
Platform Enforcement & Independence
平台有权在以下情况下对商家采取处罚措施(无需提前通知):收到消费者有效投诉且商家未能合理回应;发现商家存在违法经营、虚假宣传或违规行为;执法机构或监管部门发出相关通知。处罚措施包括:删除违规内容、暂停店铺显示、永久注销账号。平台保留将相关证据提交执法机构的权利,但并无此义务。
Link NY News may take enforcement actions against merchants (without prior notice) when: valid consumer complaints go unaddressed; evidence of illegal operation, false advertising, or policy violations is found; or notification is received from law enforcement or regulatory bodies. Enforcement actions include: removal of non-compliant content, suspension of listings, or permanent account termination. Link NY News reserves but does not assume the obligation to submit evidence to law enforcement.

退款、退货与服务纠纷政策
Refund, Return & Service Dispute Policy
本地商家须依照以下标准处理消费者退款、退货与服务纠纷:
- 服务未履约退款:若商家未能按约定时间或内容完成已付费服务,消费者有权要求全额退款;商家须在消费者提出申请后 5 个工作日内处理完毕。
- 服务质量争议:消费者对服务质量不满时,应首先与商家协商;商家须在 48 小时内作出回应并提出解决方案(如补做服务、部分退款等)。
- 实物商品退货:通过平台下单购买的实物商品,在收货后 7 天内如存在质量问题,商家须提供退货退款或换货服务,退货运费由商家承担;非质量原因退货须双方协商一致。
- 预付款与套餐:消费者在使用预付充值或套餐服务期间,若商家停业、变更业务或无法继续提供服务,须按未消费金额比例向消费者退还余额,退款期限不超过 14 个工作日。
- 平台介入:若商家在规定期限内未响应或拒绝合理退款,消费者可向平台提交投诉;平台有权依据调查结果从商家账户扣除相应金额、暂停店铺或永久注销账号,并可将涉嫌欺诈情况上报纽约市消费者保护局(DCWP)。
Local merchants must handle consumer refunds, returns, and service disputes according to the following standards:
- Unfulfilled service refunds: If a merchant fails to deliver a paid service as agreed, the consumer is entitled to a full refund; the merchant must process the refund within 5 business days of the consumer's request.
- Service quality disputes: When a consumer is dissatisfied with service quality, they should first negotiate with the merchant; the merchant must respond within 48 hours and propose a resolution (e.g., redo the service, partial refund).
- Physical goods returns: For physical products ordered through the platform, if a quality issue exists within 7 days of receipt, the merchant must offer a return-and-refund or exchange; return shipping is the merchant's responsibility. Non-quality returns require mutual agreement.
- Prepayments & packages: If a merchant ceases operations, changes business scope, or can no longer provide services during an active prepaid or package period, the merchant must refund the unused balance proportionally within 14 business days.
- Platform intervention: If a merchant fails to respond within the required timeframe or unreasonably refuses a refund, consumers may file a complaint with Link NY News. Link NY News may deduct the relevant amount from the merchant's account, suspend or permanently revoke the merchant's listing, and may report suspected fraud to the NYC Department of Consumer and Worker Protection (DCWP).
